Oregon's domestic partnership law on hold
PORTLAND, Ore. (AP) - A federal judge on Friday placed on hold a state domestic partnership law that was set to take effect in Oregon on Jan. 1, pending a February hearing. The law would have given some spousal rights to gay couples. Opponents asked U.S. District Judge Michael W. Mosman to intercede after the Oregon secretary of state's office ruled in October that they had failed to collect enough valid signatures on a referendum to block the law. The Oregon measure covers benefits related to inheritance rights, child-rearing and custody, joint state tax filings, joint health, auto and homeowners insurance policies, visitation rights at hospitals and others. It does not affect federal benefits for married couples, including Social Security and joint filing of federal tax returns. After the legislature approved the domestic partnership law this year, gay rights opponents launched an effort to collect enough signatures to suspend the law and place it on the November 2008 ballot for a statewide vote. But state elections officials said this fall that the effort fell 116 valid signatures short of the 55,179 needed to suspend the law. In court Friday, Austin Nimocks, a lawyer for Alliance Defense Fund, representing the anti gay rights group, said the state's review process was flawed, violating the rights of citizens who had signed petitions. "It's a fundamental right to participate in democracy," Nimocks said. Mosman said that rights of voters may indeed have been violated if their signatures were unfairly disqualified, and thus he'd grant the temporary stay. Margaret Olney, attorney for Basic Rights Oregon, the state's largest gay rights group, said the judge "misunderstood the referendum process in a number of ways. " "The idea that there is some individual vested right when you sign your name is wrong," Olney said. "It's equating a signature to a vote." Another Oregon law scheduled to take effect Jan. 1 that outlaws discrimination based on sexual orientation was not challenged in this case and will stand. In 2004, about 3,000 same-sex couples were granted marriage licenses in Multnomah County, the largest county in Oregon. But later that year, Oregon voters approved a constitutional ban on gay marriage. The Oregon Supreme Court nullified the 3,000 licenses as unconstitutional in 2005. Eight other states have approved spousal rights in some form for same-sex couples - Connecticut, Vermont, New Hampshire, New Jersey, Maine, California, Washington and Hawaii. Massachusetts is the only state that allows gay couples to marry. Judge Mosman said he wanted a speedy resolution in the case, saying that would be more "to the public's advantage than to be in a state of limbo."

· The Trafficking Victims Protection Reauthorization Act passed the House on a vote of 405-2! Concerned Women for America (CWA) played a pivotal role in the passage this week of historic legislation to end modern-day slavery. The bill contains all the provisions that Dr. Janice Shaw Crouse, Director and Senior Fellow of CWA's Beverly LaHaye Institute, and Shari Rendall, CWA's Director of Legislation and Public Policy, have advocated over the past several months for the reauthorization of H.R. 3887. This bill represents the work of a unique left-right, bipartisan coalition working with Congressional leadership to craft a bill to rescue millions of enslaved victims and allow the effective prosecution of the criminal networks that are behind this crime that is ranked #2 in international crimes. The bill now goes to the Senate for debate, and the CWA team will be working to ensure passage in that body as well.
· Dr. Crouse was interviewed on numerous radio stations regarding the new CDC report that claims that teen births have increased. Dr. Crouse's analysis of the details of the report reveals really good news — the birth rates dropped among 10-17-year-olds. The CDC numbers were distorted by the increase in birth rates among 18- and 19-year-olds. Crouse argues that abstinence programs need to be fully funded so that the programs targeting the 10-17-year-olds can continue to produce such good results. She regrets the fact that older teens are not getting the abstinence message.
· This week, Americans for Truth held a press conference at the National Press Club and invited Matt Barber, Policy Director for Cultural Issues, to join in to discuss the unlawful and unimaginable acts that took place at this year's Folsom Street Fair held in San Francisco. Matt Barber explained that "during San Francisco's Folsom Street Fair, total nudity and the most unimaginable and vile acts of debauchery are commonplace. These acts are performed in public, which is illegal, and are even done in the presence of children. Additionally, anti-Christian bigotry is a central part of the event's theme." Madison, WI (LifeNews.com) -- Two teams of scientists say they have devised a new process that allows for the creation of embryonic stem cells without the destruction of human life. The reports could be good news for pro-life groups who oppose the research because days-old unborn children are normally killed for their cells. Stem cell pioneers in Wisconsin and Japan released studies in the medical journals Science and Cell that claim to have found a way -- called direct reprogramming -- to make adult stem cells revert to their embryonic form.
The studies confirm that human skin cells (fibroblasts) can be used to make pluripotent stem cells sharing essentially all the features of human embryonic stem cells.
Dr. Shinya Yamanaka of Kyoto University and his team published the Cell paper while James Thomson of the University of Wisconsin-Madison, who discovered embryonic stem cells, published the Science paper.
Yamanaka previously reported, in 2006, turning mouse cells into semi-embryonic ones and then, earlier this year, he said he had produced cells that were almost indistinguishable from embryonic ones.
Both teams moved on from animal cells and Yamanaka's was able to convert the skin cells from a 36-year-old woman into embryonic ones while Thomson's team worked with cells from a newborn baby.
The technique involves the introduction of 4 genes into the skin cells, thereby "reprogramming" them to a less specialized (pluripotent) state.
The newly-produced embryonic stem cells are known as "iPS" cells.
The good news about the process is that it can be replicated easily, Thomson told AP. That could mean labs across the world could produce embryonic stem cells without destroying human life.
"People didn't know it would be this easy," Thomson said. "Thousands of labs in the United States can do this, basically tomorrow."
The new technique isn't without problems as the researchers must disrupt the DNA of the skin cells to begin the process of reverting to embryonic form. This has the potential of causing cancer in the cells.
As a result, the cells may not be able to be used for medical transplants for patients suffering from diseases such as diabetes or Parkinson's.
“As long as we use those viruses, I don’t think we can say that the [reprogrammed] cells are as safe as embryonic stem cells,” said Dr. Yamanaka.

After weeks of political wrangling, the Senate finally cried uncle on an unpopular plan to attach "hate crimes" legislation to the Defense Authorization bill. By pulling the proposal before members could even vote on it, Democrats demonstrated just how little real support the legislation enjoyed--even among the party faithful. With Congress a month out from primary season and our troops in desperate need of resources, one Democratic aide told reporters that "hate crimes" had nowhere near the backing it needed to pass. "We're about 40 votes short, not four or six," he said. "Fed up" with the sheer volume of emails they received (which is how one office described your overwhelming response to FRC's alert), the leadership made a wise decision to drop the provision. Had they not, it would have likely caused serious PR problems--not only for them but for a number of their Democratic colleagues running in the presidential primaries next month. For our military, however, the damage may have already been done. The months of delay may not have affected Congress, which operates within the safety and comfort our troops provide, but it has certainly affected the ability of our brave men and women to do their jobs. This should be an embarrassment to the majority. We congratulate Senator Mitch McConnell (Ky.) and Reps. Roy Blunt (Mo.) and John Boehner (Ohio), who were instrumental in the provision's defeat--as were those of you who took the time to make your opinions known. Sen. Kennedy's hate crime amendment, approved by the U.S. House and Senate, was stripped from the National Defense Appropriations Act, H.R. 1585, midday Thursday. Congressional Quarterly reports that support for the arms/hate bill bureau had so eroded in the House that Democrats were forty votes short of passage.
This great victory confirms that massive last-minute opposition from the evangelical and far right may well have powerfully helped defeat it. Sens. Kennedy and Smith may attempt to revive it as stand-alone legislation after the first of the year. But its rejection by Conference greatly increases the likelihood that we can defeat it again - if lovers of freedom continue to protest loudly.

Throughout his presidency, the Science Intelligentsia has castigated President Bush for placing limits on the federal funding of embryonic-stem-cell research (ESCR). Acting as if he had a banned ESCR, which of course he hadn't, "the scientists" and their camp followers in the media and on Capital Hill accused the president of withholding cures from the ill in order to impose his religious beliefs on a reluctant public. Little noted in all of the caterwauling, was that ESCR and human-cloning research (SCNT) have been funded bounteously — to the tune of nearly $2 billion. Not only has the National Institutes of Health put more than $150 million in recent years into human ESCR (about $40 annually), but according to a recent report put out by the Rockefeller Institute, to date about $1.7 billion has poured into ESCR and SCNT from philanthropic sources — and this doesn't include the hundreds of millions granted annually by the states for cloning and ESCR experiments. So what's really going on here? Yes, the president's policies have forced some research centers to set up separate labs for research on Bush-approved- and non-approved, stem-cell-research lines. But what really got under "the scientists" skin was the clarion moral message sent by the president: It is wrong to treat nascent human life as a mere natural resource to be sown, reaped, and consumed. Madison, WI (LifeNews.com) -- The new method of producing embryonic-like stem cells that two teams of scientists have devised could help combat an issue that has plagued embryonic stem cell research. The controversial science has never been able to overcome immune system rejection issues that don't inhibit the use of adult stem cells. LifeNews.com reported on Tuesday that scientists in Japan and Wisconsin released studies in the medical journals Science and Cell that claim to have found a way -- called direct reprogramming -- to make adult stem cells revert to their embryonic form. Pro-life groups have supported the use of adult stem cells because they don't come with the ethics problems associated with the destruction of human life. Wisconsin stem cell scientist James Thomson says the direct reprogramming process appears to eliminate that concern but may also eliminate the problem scientists have had of using embryonic stem cells in medical transplants. Reprogramming an individual's own cells to mimic stem cells provides a way to create individually tailored transplant tissue unlikely to be rejected by that person's immune system. "These cells should be perfectly matched with the patient, so the immune system should not attack it. Lawmakers Still Want Destructive Embryonic Stem Cell Research Funding
Washington, DC (LifeNews.com) -- Though two teams of scientists have shown that human life need not be destroyed to obtain embryonic stem cells for research, Congressional lawmakers are not giving up on their fight to force taxpayers to fund it. And the scientists involved in the new research say they shouldn't give up. As LifeNews.com reported Tuesday, teams of scientists from Wisconsin and Japan have created a new method of turning adult stem cells back into embryonic ones. Previously, scientists had to kill days-old unborn children to obtain their embryonic stem cells for studies. Though President Bush and pro-life groups have called on Congress to quit trying to force taxpayers to fund destructive research, lawmakers say they won't back down. "It's terribly wrong for any politician to be trying to pick and choose one type of ethical research over another," Rep. Diana DeGette, a key sponsor of past funding bills, told AP. "That issue isn't going away." Senator Tom Harkin of Iowa, a leading sponsor of measures there, agreed. "Scientists may yet find that embryonic stem cells are more powerful," he said. ADF Files Lawsuit to Restore Marriage Between a Man & Woman Only in Oregon

Voters who signed referendum to repeal Legislature's civil union bill go to court over their wrongfully rejected signatures PORTLAND, Ore. - Attorneys with the Alliance Defense Fund filed a lawsuit Monday in federal court against the Oregon Secretary of State and several county clerks after those offices wrongfully invalidated voters' signatures on a citizen referendum. If sustained, the referendum would place onto the November 2008 ballot an option for voters to repeal the state legislature's domestic partnership bill. "Our country is founded on the basic principle of government of the people, by the people, and for the people. It is un-American that Oregon citizens are being denied the right to have their vote count in an important referendum," said ADF Senior Legal Counsel, Austin R. Nimocks. "The county clerks must fulfill their duty, which is to make sure that every citizen's legitimately submitted signature counts," Nimocks added. "The right to exercise one's voice in the democratic process is a crucial one, and state and county officials must not infringe upon that right." ADF attorneys filed a lawsuit on behalf of several Oregonians whose signatures were invalidated by clerks' offices in 12 different counties. Many of the citizens sought, in person, to have their signatures revalidated since no legitimate reason existed to reject their signatures, but the clerks refused. Signatures were improperly invalidated for various reasons, including determinations that signatures did not match their corresponding voter registration cards, though they did. Other signatures were excluded for voters allegedly not being registered, though they were. Another signer's signature was excluded because the clerk considered the signature "illegible," though it could be read. None of the 254 signers who had their signatures excluded by clerks were ever contacted about the matter. "In Oregon elections, where most citizens vote by mail, voters are routinely contacted about missing, old, or non-matching signatures, all in an effort to give the voter every chance to make sure that their vote counts," Nimocks explained. Voters who signed referendum to repeal Legislature's civil union bill go to court over their wrongfully rejected signatures PORTLAND, Ore. - Attorneys with the Alliance Defense Fund filed a lawsuit Monday in federal court against the Oregon Secretary of State and several county clerks after those offices wrongfully invalidated voters' signatures on a citizen referendum. If sustained, the referendum would place onto the November 2008 ballot an option for voters to repeal the state legislature's domestic partnership bill. "Our country is founded on the basic principle of government of the people, by the people, and for the people. It is un-American that Oregon citizens are being denied the right to have their vote count in an important referendum," said ADF Senior Legal Counsel, Austin R. Nimocks. "The county clerks must fulfill their duty, which is to make sure that every citizen's legitimately submitted signature counts," Nimocks added. "The right to exercise one's voice in the democratic process is a crucial one, and state and county officials must not infringe upon that right." ADF attorneys filed a lawsuit on behalf of several Oregonians whose signatures were invalidated by clerks' offices in 12 different counties. Many of the citizens sought, in person, to have their signatures revalidated since no legitimate reason existed to reject their signatures, but the clerks refused. Signatures were improperly invalidated for various reasons, including determinations that signatures did not match their corresponding voter registration cards, though they did. Other signatures were excluded for voters allegedly not being registered, though they were. Another signer's signature was excluded because the clerk considered the signature "illegible," though it could be read. None of the 254 signers who had their signatures excluded by clerks were ever contacted about the matter. "In Oregon elections, where most citizens vote by mail, voters are routinely contacted about missing, old, or non-matching signatures, all in an effort to give the voter every chance to make sure that their vote counts," Nimocks explained. Friday, November 30 marked the end of what will forever be remembered as the longest and most courageous battle between one man, a man we all know as the world's greatest daredevil, and death. Robert Craig "Evel" Knievel died in Clearwater, Florida, finally succumbing after nearly a three-year bout with the terminal lung disease, idiopathic pulmonary fibrosis. He was 69. His death was preceded by more than 40 years of constant battle against the persistent pain of broken bones and severe trauma after jumping and crashing motorcycles like no man had ever done before. In addition, he fought to overcome the tremendous obstacles of diabetes, hepatitis C, a liver transplant, numerous surgeries and two strokes. Knievel's legacy as America's Legendary Daredevil, Last of the Gladiators, and King of the Stuntmen will undeniably live on among millions of fans, past, present and future. However, the memories of the man apart from his legend will live on even stronger in the hearts of his friends and family. Despite his well-known swagger of self confidence, the legacy he wished for most of all was simply to be an inspiration.
"The fame of great men ought to be judged always by the means they used to acquire it." By this maxim, nothing will ever be able to take away or challenge the things accomplished by Evel Knievel. Whether it was unmatched courage or just an absolute unwillingness to give in to fear, Robert Craig Knievel was a man's man through all the days of his life. He took great pride in the simply stated, yet most difficult to accomplish principles: always living up to his word, never shirking the responsibility or consequences for his actions regardless of the personal risk, and never, not ever, failing to stop trying. Knievel was born in Butte, Montana on October 17, 1938 to Robert Edward and Ann (Keough) Knievel. He and his younger brother Nic were raised by the loving family of paternal grandparents Ignatius and Emma Knievel. Growing up and living in Butte were some of the most valued times of his life. His fame took him far and wide across the country and even over seas, but Knievel never let go of the love and pride he had for his hometown. Growing up in a blue-collar mining town, Knievel attended Butte public schools before serving in the U.S. Army reserves. As a young man he was always an exceptional athlete, hard worker and determined individual. Knievel explored and excelled in many different professions, if only for a short time, before finding his calling as the ultimate daredevil. During his prime as a bona fide celebrity, Knievel enjoyed his spoils to the highest. He loved fast cars, private airplanes, fancy yachts and the finest clothes and jewelry money could buy. He was sought out by Hollywood and remained friends with many famous people until his death. In the end, he had a few regrets, but he always sincerely strived to do the right thing. He never forgot who his real friends were. He never forgot his love for his family. And he never forgot the place from where he came, what he'd learned or what others had done to help him get to where he did. The red, white and blue for which he is famous were a tribute to his Butte character as much as they were for America. In his last years, one of the greatest honors was being able to share his hometown with his world of fans and to participate and take pride in the celebration of his annual event, "Evel Knievel Days." He dearly loved his grandchildren and he always made it a point to stay in touch with the people he loved the most, his friends and family. And lastly, most important to him above all was his new-found faith in Jesus Christ. Just as he always took great care in surrounding himself with the best people he could depend upon to help him make his jumps during his motorcycle career, Knievel found his greatest friend of all in preparation for his final leap from life. He was profoundly happy that he gave his life to God, who comforted him and gave him the strength he needed to make it through the end. Knievel is survived by his loyal friend and wife, Krystal Kennedy-Knievel, whom he married in 1999. She stood by his side through his greatest struggles with health until his death. His in-laws include Krystal's mother Sylvia and her husband Wayne Croft; father Glen Kennedy, and Krystal's sister Shawn and husband Rory with their two children. He is also survived by his former wife of 38 years, Linda Bork Knievel. Though they divorced, Linda and Evel had four children that all made them proud. Son, Kelly Knievel and daughter-in-law Shelli with granddaughter Lily; son, Robbie Knievel and granddaughters Krysten and Karmen, with great-granddaughter Analiese; daughter Tracey and son-in-law Mitch McLeod with grandchildren Josiah, Jesse, Melody, Cody, Cole, Casey and Dusty with wife Rachel and great-granddaughter Lucy; and his youngest daughter Alicia, with son-in-law Matt Vincent and grandchildren Madelyn, Jaicee, Rye and his sixteenth grandchild expected this June. Other surviving family members include his stepmother, Mrs. Robert Edward Knievel; brother, Nic and his wife Rusty; sister, Kristy and brother-in-law Hugh Lawrence; sister, Renee and brother-in-law Bill Slaughter; sister Robin and brother-in-law John Dick; and sisters Loretta Young and Kadie Boney. His is also survived by numerous nieces, nephews, extended family, friends and his millions and millions of fans. Public services will be held for family, friends and fans at the Butte Civic Center at 11:00 a.m. on Monday, December 10th. A private Christian burial and graveside services will take place at the Mountain View Cemetery. | ||
